Terms of Service

These Terms of Service (“Terms”) govern your use of Sonic Shootouts at sonicshootouts.com (the “Service”), operated by Neyrinck LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 16 years old to use the Service. You are responsible for the activity under your account and for keeping your password secure. Provide accurate information when you register and keep it up to date. You may close your account at any time by emailing info@neyrinck.com.

2. Your content and rights

You retain ownership of the audio files, titles, descriptions, and other content you upload (“Your Content”). You grant us a non-exclusive, worldwide license to host, store, reproduce, and display Your Content solely to operate and provide the Service, including making it available to other users where you choose to publish it.

You represent and warrant that you own Your Content or have all rights and permissions necessary to upload it and grant the license above, and that Your Content does not infringe any third party’s intellectual property, privacy, or other rights. Do not upload audio you are not authorized to share.

3. Acceptable use

You agree not to use the Service to:

• upload content you do not have the rights to share;
• infringe intellectual property, privacy, or publicity rights;
• upload unlawful, harmful, harassing, or deceptive content;
• attempt to breach security, disrupt, reverse engineer, or overload the Service; or
• use automated means to scrape or harvest content or data without our permission.

We may remove content or suspend or terminate accounts that violate these Terms.

4. Intellectual property

The Service itself, including its software, design, and branding, is owned by Neyrinck LLC and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding.

5. Copyright complaints

If you believe content on the Service infringes your copyright, contact us at info@neyrinck.com with a description of the work, the location of the material, and your contact information. We will respond to valid notices, including by removing infringing content.

6. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free.

7. Limitation of liability

To the fullest extent permitted by law, Neyrinck LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as content licenses you granted, disclaimers, and limitations of liability) will survive.

9. Governing law

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-laws rules. The courts located in California will have jurisdiction over disputes, except where applicable law gives you the right to bring a claim in your country of residence. Nothing in these Terms limits any mandatory consumer-protection or data-protection rights you have under the laws of your country, including the GDPR or UK GDPR for users in the EU and UK.

We may update these Terms from time to time. When we make material changes, we will update the effective date above. Continued use of the Service after an update means you accept the revised Terms.
